SUBJECT: EXPIRATION OF THE ANDEAN TRADE PREFERENCE ACT (ATPA)

BACKGROUND:
THE ATPA IS SCHEDULED TO EXPIRE AT MIDNIGHT ON DECEMBER 4, 2001.
LEGISLATION TO EXTEND THE PROGRAM IS PENDING, BUT IS NOT LIKELY
TO BE ENACTED PRIOR TO DECEMBER 4, 2001.
MERCHANDISE ENTERED, OR WITHDRAWN FROM WAREHOUSE, FOR CONSUMPTION ON
OR AFTER DECEMBER 5, 2001, WILL NOT BE ELIGIBLE FOR PREFERENTIAL
TARIFF TRETMENT UNDER THE ATPA.
ACTION:
EFFECTIVE DECEMBER 5, 2001, MERCHANDISE ENTERED, OR WITHDRAWN FROM
WAREHOUSE, FOR CONSUMPTION WILL NOT BE ELIGIBLE FOR PREFERENTIAL TARIFF
TREATMENT UNDER THE ATPA, UNLESS CONGRESS TAKES ACTION TO EXTEND THE
ACT. DUTIES MUST BE DEPOSITED FOR ALL MERCHANDISE ENTERED ON OR AFTER
THAT DATE. USE OF THE SPECIAL PROGRAM INDICATOR "J" WILL RESULT IN
REJECTION OF THE ENTRY SUMMARY FOR SUCH MERCHANDISE.
IF CONGRESS TAKES ACTION TO RENEW THE ATPA WITH RETROACTIVE EFFECT, A
MESSAGE DESCRIBING THE PROCESS FOR REQUESTING REFUNDS WILL BE ISSUED.
COPIES OF THIS MEMORANDUM SHOULD BE MADE AVAILABLE TO PORT DIRECTORS;
ASSISTANT PORT DIRECTORS, TRADE; IMPORT AND ENTRY SPECIALISTS;
INSPECTORS; BROKERS, IMPORTERS AND OTHER INTERESTED PARTIES.
