SUBJECT: CHANGES TO CUSTOMS PROTEST SYSTEM REQUIRED BY THE
MISCELLANEOUS TRADE AND TECHNICAL CORRECTIONS ACT
OF 2004
THIS IS TO ADVISE THAT THE CHANGES TO THE ACS PROTEST SYSTEM
REQUIRED BY THE MISCELLANEOUS TRADE AND TECHNICAL CORRECTIONS ACT OF
2004, AS DESCRIBED IN ADMINISTRATIVE MESSAGE 05-0084 DATED 01-27-05,
HAVE BEEN MADE AND ARE EFFECTIVE IN ACS AND ABI AS OF THE DATE OF
THIS NOTICE.
THESE CHANGES INCLUDE CHANGES TO ABI AND ACS EDITS TO
ACCOMMODATE: THE LENGTHENING OF THE FILING PERIOD FOR 514 PROTESTS
TO 180 DAYS FROM THE DATE OF THE PROTESTED DECISION; THE ELIMINATION
OF THE 90 DAY WAITING PERIOD TO REQUEST ACCELERATED DISPOSITION OF A
514 PROTEST; AND THE REPEAL OF SEC. 520(C) FOR PETITIONS.
ADDITIONALLY, THE ACS PROTEST SYSTEM WILL NOW RETURN A
WARNING MESSAGE WHEN THE DATE OF FILING OF A 520(D) CLAIM IS
GREATER THAN 1 YEAR FROM THE DATE OF IMPORTATION. TO ACCOMMODATE
THE INCLUSION OF 520(D) PETITIONS FOR COMMODITIES FROM CHILE,
THE COUNTRY CODE "CL" CAN NOW BE USED WHEN SUBMITTING NAME AND
ADDRESS INFORMATION FOR A PROTESTANT.
