INTERIM GUIDELINES FOR ENTERING MERCHANDISE TRANSPORTED VIA PIPELINES

The purpose of this message is to notify the trade of interim filing options for merchandise transported via pipelines. The options are meant to maximize the benefits of automation and to facilitate entry and clearance without compromising accurate recordation and collection of revenue. It is envisioned that once enhanced modernization is achieved through the Automated Commercial Environment (ACE) these procedures will be revisited.

Currently, merchandise transported via pipelines may be processed under the monthly consolidated entry of non-dutiable merchandise procedures as established in a Bureau of Customs Circular dated July 1, 1970. In accordance with this circular, manifests are to be submitted daily and later consolidated to a monthly entry summary. This monthly entry summary must be filed within 10 calendar days after the end of the month. The streamlined procedures were implemented prior to automation (ACS), the Reconciliation Prototype, Remote Location Filing (RLF) and Electronic Invoice Program (EIP). The Office of International Trade has recently reevaluated these procedures in light of the aforementioned programs.

The following are the interim filing options for merchandise transported via pipelines:

NAFTA Qualifying Merchandise

North American Free Trade Agreement (NAFTA) eligible merchandise, as defined in General Note 12 of the Harmonized Tariff Schedule of the United States Annotated (HTSUSA) and 19 C.F.R. § 181.131, that is transported via pipeline may be entered using RLF/EIP and the monthly consolidated entry procedures as outlined in the Circular dated July 1, 1970.

Non-NAFTA Qualifying Merchandise

Option A

Non-NAFTA qualifying merchandise transported via pipeline may be entered using RLF/EIP on a daily basis. When this method is used, the entry summary should be flagged for value reconciliation.

Option B

Non-NAFTA qualifying merchandise transported via pipeline may be entered using the monthly consolidated entry procedures; however it cannot be filed using RLF/EIP. A paper monthly consolidated entry summary must be filed according to the procedures outlined in the July 1, 1970 Circular.
