This memorandum provides information regarding modifications to the action taken by the United States Trade Representative (USTR) in connection with the World Trade Organization authorization in the European Community (EC)-Beef Hormones dispute. The modifications, implemented in the form of chapter 99 provisions of the Harmonized Tariff Schedule of the United States (HTS), are published in the attached Federal Register Notice (FRN), dated January 23, 2009.
The modifications described in the Annex to the FRN shall be effective with respect to products that are entered, or withdrawn from warehouse, for consumption on or after March 23, 2009. Any merchandise subject to increased duties under this determination that is admitted to U.S. foreign-trade zones on or after March 23, 2009 must be admitted as “privileged foreign status” as defined in 19 CFR 146.41.
The HTS is modified by adding subheadings to subchapter III of chapter 99, imposing 100 percent ad valorem duties on several products from certain EC member states and 300 percent ad valorem on Roquefort cheese (provided for in subheading 0406.40.20 and 0406.4040) – Annex A of the FRN. Additionally, the notice deletes the existing chapter 99 subheadings established in July 1999 for the purpose of implementing the prior action, effective March 23, 2009 – Annex B of the FRN.
