OMAN FREE TRADE AGREEMENT SYSTEM REQUIREMIENTS
THIS MESSAGE IS BEING SENT TO ADVISE THE TRADE ON THE SYSTEM REQUIREMENTS NEEDED TO FILE AN OMAN FREE TRADE ACT CLAIM. THE OMAN FREE TRADE AGREEMENT IS EFFECTIVE FOR MERCHANDISE THAT HAS A DUTY COMPUTATION DATE OF 01/01/2009. THE CATAIR, ENTRY SUMMARY SECTION, RECORD IDENTIFIER 10, NOTE 3, DESCRIBES THE DUTY COMPUTATION DATE.
THE AUTOMATED COMMERCIAL SYSTEM (ACS) HAS NOT BEEN PROGRAMMED YET TO ACCEPT OMAN FTA CLAIMS. A FUTURE MESSAGE WILL BE SENT TO THE TRADE INDICATING WHEN THEY CAN BEGIN FILING OMAN FTA CLAIMS THROUGH THE ABI SYSTEM.
TO CLAIM THE OMAN FREE TRADE ACT BENEFIT, THE FOLLOWING ABI SYSTEM REQUIREMENTS MUST BE MET:
1)THE SPI INDICATOR 'OM’ (ISO CODE FOR OMAN) MUST BE FILED. THE SPI INDICATOR IS REPORTED ON THE ENTRY SUMMARY RECORD IDENTIFIER 50 (INPUT). SPECIAL PROGRAMS COUNTRY INDICATOR FIELD (POSITIONS 78 – 79) OR RECORDS 70/80/81 SPECIAL PROGRAM INDICATOR (COUNTRY) FIELD (POSITIOINS 79 – 80).
2)THE COUNTRY OF ORIGIN MUST BE ‘OM’ (OMAN). THE COUNTRY OF
ORIGIN FIELD IS REPORTED ON THE ENTRY SUMMARY RECORD IDENTIFIER 40 (INPUT), POSITIONS 6 -7.
3)THE COUNTRY OF EXPORT MUST BE ‘OM’(OMAN). THE COUNTRY OF EXPORT FIELD IS REPORTED ON ENTRY SUMMARY RECORD IDENTIFIER 50, POSITIONS 69 – 70.
4)THE TARIFF NUMBER WITH THE OMAN FREE TRADE ACT CLAIM MUST CONTAIN THE SPECIAL PROGRAM INDICATOR ‘OM’. THE TARIFF NUMBERS WITH THE OMAN FREE TRADE INDICATOR MAY HAVE EITHER A FREE OR A REDUCED DUTY RATE. IF THE RATE IS REDUCED, THE DUTY RATE WILL BE INDICATED IN THE SPECIAL RATE FIELD ASSOCIATED WITH THE ISO CODE ‘OM’.
5)THE OMAN FREE TRADE ACT WILL HAVE TARIFF NUMBERS THAT ARE SUBJECT TO TARIFF RATE QUOTA AND OTHER SPECIAL PROVISIONS (TARIFF NUMBERS BEGINNING WITH 9916).
6)THE MERCHANDISE PROCESSING FEE (CLASS CODES 499/311) IS EXEMPT FOR OMAN FTA CLAIMS (SPI ‘OM’) EXCEPT FOR THE OMAN TRADE PREFERENCE LEVEL (TPL) TARIFF NUMBER 99169920 WHICH REQUIRES THE MERCHANDISE PROCESSING FEE.
THERE WILL BE SITUATIONS WHERE A TARIFF NUMBER IS DUTY FREE. DUTY FREE TARIFF NUMBERS DO NOT HAVE SPECIAL PROGRAM INDICATORS. IF THE MERCHANDISE ASSOCIATED WITH THE DUTY FREE TARIFF NUMBERS QUALIFIES UNDER THE OMAN FTA PROVISIONS, THE MERCHANDISE PROCESSING FEE WILL BE EXEMPT BY TRANSMITTING THE SPI ‘OM’ INDICATOR.
A TARIFF UPDATE WITH THE OMAN FTA RATES WILL BE SENT OUT TO THE TRADE WHEN THE RATES HAVE BEEN UPDATED INTO THE ACS SYSTEM.
THE TRADE WILL BE NOTIFIED BY CBP WHEN THEY CAN BEGIN FILING OMAN FTA CLAIMS THROUGH THE ACS ABI SYSTEM.
