Title:Implementation of CUSRES Responses to BAPLIE Submissions Relating to ISF (10+2)

On October 15, 2009, CSMS #09-000325 was issued to notify the trade that the CUSRES response to BAPLIE stow plan submissions was posted to the cbp.gov website at:

The plan was to implement this response after 60 days in mid-December, but was delayed on December 4, 2009 via CSMS #09-000361 based on a number of concerns, including proximity to the holiday season with typically low staffing for both the trade and CBP. Since that time, CBP has received significant feedback from the trade indicating that the complexity of this new data format requires additional time in order to complete system modifications to properly process this message. In light of these concerns, CBP has agreed to delay the implementation for approximately an additional 30 days from now. Once an official date is determined, CBP will notify the trade via CSMS message approximately one week in advance.

At the time of implementation, trade users must be aware that they will NOT receive a response from CBP for BAPLIE stow plan messages when they fail to supply proper SCAC or CBP assigned 4-character site and filer codes which identify a specific profile assigned to the filer in AMS. On June 4, 2009, CBP published guidance regarding vessel stow plans, which includes the elimination of BIC codes. While CBP has allowed the submission of these codes, the implementation of the new CUSRES will result in no response from CBP for those parties who continue to submit their stow plans using BIC codes.

One other point to make note of is the batch number that will be returned to filers in the CUSRES response. This unique number will be returned to the filer as the INTERCHANGE CONTROL REFERENCE (element 0020) in the UNB header record. This batch number will be similar to what is returned in other AMS responses, including MR, AR, and 355 transactions. HOWEVER, batch numbers sent for BAPLIE transactions will be assigned separate and apart from batch numbers returned in response to other AMS submissions. Based on the separate sequencing of this number, some overlap of batch numbers is possible to occur between BAPLIEs and other responses. When discussing issues with CBP, filers must be clear that the batch number being provided to CBP is for a BAPLIE stow plan.

While this delay will push implementation past January 26, 2010, CBP intends to follow all enforcement procedures relating to Importer Security Filing (ISF - 10+2) requirements, including the filing of stow plans for all required vessels.
