The Generalized System of Preference (GSP) expired for goods entered or withdrawn from warehouse subsequent to December 31, 2010 in accordance with 19 CFR 141.68. This long-running trade preference program has lapsed and been renewed previously and there is an expectation that Congress will consider reauthorization of the program in early 2011, likely to be retroactive to January 1, 2011.
ATPA/ATPDEA and the Peru TPA
The Andean Trade Preference Act (ATPA) and Andean Trade Promotion and Drug Eradication Act (ATPDEA) were extended for goods entered or withdrawn from warehouse through February 12, 2011 for Columbia and Ecuador but not for Peru. Peruvian goods are no longer eligible for preference under either of these programs but continue to receive benefits under the Peru Trade Promotion Agreement (PTPA), special program indicator (SPI) “PE”.
GSP
Importers should pay the normal trade relations (column 1) duty rate but continue to flag GSP-eligible imports with the applicable special program indicator (SPI) until further notice. Use of the SPI will help facilitate duty refunds if the program is renewed retroactively. (See also Cargo Systems Messaging Services [CSMS] #11-000003 and #10-000292.) CBP will issue additional instructions upon renewal of the GSP.
