Title:Automotive Products Trade Act (APTA) Claims

U.S. Customs and Border Protection (CBP) ceased honoring preference claims for automotive parts under the Automotive Products Trade Act (APTA) (special program indicator "B" and "B#") effective December 31, 1997, when the U.S. Department of Commerce, International Trade Administration advised that it had stopped certifying "bona fide motor-vehicle manufacturers," a precondition to an APTA preference claim.

Although the APTA is still in effect, and can be found in Harmonized Tariff Schedule of the United States (HTSUS) General Note 5(a)(v), its utility has been supplanted by the North American Free Trade Agreement (NAFTA), and its applicability to automotive parts ended when the outstanding "bona fide" letters expired in 1997.
