Title: FTA Origination Analysis and Certification when no Tariff Change Rule (TCR) Exists
Manufacturers, exporters and importers are advised that a very limited number of tariff items in the Harmonized Tariff Schedule of the United States (HTSUS) do not have corresponding free trade agreement (FTA) tariff change rules (TCRs) because they were negotiated using a Harmonized Tariff Schedule (HTS) that was subsequently modified in 2007 and 2012 and the corresponding TCR rules have yet to be implemented.
This situation applies to a very limited number of tariff item under the following FTAs:

Until revised TCRs are implemented, manufactures of affected goods seeking to perform a TCR origination analysis should perform the operation classifying both the good and its materials in accordance with the most recent HTSUS that has both the tariff item and the corresponding TCR.
Until revised TCRs are published, the certification should indicate both the current HTSUS number and the corresponding HTSUS number used to perform the TCR analysis.
