In an effort to keep the trade community aware of important information addressed on the Weekly ACE Status Update Call, the ACE Business Office sends out weekly FAQs to address important ACE-related topics. Below please find FAQs related to last week's call:

1. FDA Regulation of LED Products

Question: Does FDA regulate LED products? Is more information available on the new FD2 flagging of some HTS codes?

Answer: Yes, FDA regulates LED products. The FD flag change does not change FDA's requirements regarding LED products. For questions regarding transmitting LED products in ACE, please contact ACE_Support@FDA.hhs.gov and FDA's Center for Devices and Radiological Health, cdrhocimport@fda.hhs.gov, with the specific product information.

2. FDA ACS Messaging Update

Question: When will FDA be turning off FDA ACS transactions?

Answer: On February 23, 2017, certain inbound and outbound FDA ACS transactions will be turned off. For more details on the specific transactions being turned off February 23rd and for future shutoff dates, please see CSMS #17-000055.

3. Changes to ATF Document Submission

Question: May ATF Forms 6 and 6A be submitted electronically in ACE via the Document Image System (DIS)?

Answer: No, importers filing ATF information electronically through ACE are required to use the PGA Message Set. DIS images of ATF Forms, including Form 6 and 6A, will no longer be accepted. When the PGA Message Set is filed correctly, the importer will receive an automatic “May Proceed” from ATF, and if there are no further issues, the shipment will be released. Please note, original paper ATF Forms 6 and 6A may also be submitted to the ports of entry. 4. ACE Outreach Events

Question: Where can I access recordings and other presentation materials on recent ACE events, including the recent FDA webinar held on January 31st?

Answer: Webinar recordings and all other related presentation materials for recent ACE events are available at https://www.cbp.gov/trade/ace/upcoming-ace-outreach-events-trade.
