This document reiterates that post summary correction (PSC) is available for a post-importation preference claim only when the applicable preference program does not specify that such a claim be made via 19 USC 1520(d).

Where the preference program specifies that a post-importation claim must be made via 19 USC 1520(d), then submission through the ACE protest module is the sole electronic platform available and requires that the importer or broker have a protest filer number. Non-electronic (paper) 19 USC 1520(d) claims may be submitted in person or by U.S. mail.

The following free trade agreements (FTAs) provide that 19 USC 1520(d) is the sole mechanism for a post-importation preference claim, irrespective of liquidation status: Dominican Republic-Central America Free Trade Agreement (CAFTA-DR), Chile Free Trade Agreement (CLFTA), Colombia Trade Promotion Agreement (COTPA), Korea Free Trade Agreement (KORUS), North American Free Trade Agreement (NAFTA), Oman Free Trade Agreement (OMFTA), Panama Trade Promotion Agreement (PATPA) and the Peru Trade Promotion Agreement (PETPA).

The FTAs and their corresponding regulation citations follow:

We are in the process of modifying the corresponding “BUSINESS RULES AND PROCESS DOCUMENT (Trade – External), ACE Entry Summary (BRPDs) to mirror this. (https://www.cbp.gov/document/guides/ace-entry-summary-business-process)

Please see the QUICK REFERENCE GUIDE AUTOMATED COMMERCIAL ENVIRONMENT (ACE) PROTEST PROCESSING IN ACE, https://www.cbp.gov/document/guidance/ace-protest-trade-quick-reference-guide-qrg.

Be advised that, if in addition to making a post-importation preference claim, the filer seeks to change classification, value, units, etc., this too may be submitted on the 19 USC 1520(d), as long as it is on the same tariff line as the requested preference claim.
