THIS IS TO RESCIND E-MAIL MESSAGE 1098121 DATED APRIL 9, 1991,
WHICH SUSPENDED THE CUSTOMS POLICY DELINEATED IN E-MAIL MESSAGE
1074121 DATED MARCH 15, 1991, OF INSTITUTING SUSPENSION/
REVOCATION PROCEEDINGS AGAINST THE LICENSES OF THOSE BROKERS WHO
FAIL TO PAY MONETARY PENALTIES ASSESSED PURSUANT TO ANY PROVISION
OF CUSTOMS LAW.
DISTRICT DIRECTORS MAY NOW INSTITUTE SUSPENSION/REVOCATION
PROCEEDINGS AGAINST BROKERS FOR THE FAILURE TO PAY SUCH MONETARY
PENALTIES. CAREFUL ATTENTION MUST BE GIVEN TO THE PROCEDURES FOR
SUSPENSION/REVOCATION OUTLINED IN 19 CFR 111, SUBPART D,
PARTICULARLY SECTION 111.59 PERTAINING TO PRELIMINARY
PROCEEDINGS. BROKERS SHOULD BE GIVEN THE OPPORTUNITY TO SHOW
CAUSE WHY FORMAL PROCEEDINGS SHOULD NOT BE INITIATED. IF A
BROKER SUBMITS A MERITORIUS DEFENSE, IT SHOULD BE CAREFULLY
REVIEWED BY BOTH THE DISTRICT DIRECTOR AND REGIONAL COUNSEL PRIOR
TO DECDING WHETHER TO PROCEED WITH THE SUSPENSION OR REVOCATION
ACTION.
