SUBJECT: AMENDMENT TO GUIDANCE ON APPLICABILITY OF MERCHANDISE
PROCESSING FEE
MESSAGE NUMBER 2268011, DATED SEPTEMBER 24, 1992, ADVISED
THAT IN THE CASE OF IMMEDIATE DELIVERIES, THE IMPORTER OR BROKER
MUST DESIGNATE, IN WRITING, WHICH DATE SHOULD BE CONSIDERED AS AN
ENTRY FOR MERCHANDISE PROCESSING FEE (MPF) PURPOSES.
WE HAVE SINCE BEEN ADVISED THAT IN ACCORDANCE WITH SECTION
24.23(A)(2) OF THE CUSTOMS REGULATIONS, MERCHANDISE IS CONSIDERED
ENTERED OR RELEASED IF THE MERCHANDISE IS:
I) RELEASED UNDER A SPECIAL PERMIT FOR IMMEDIATE DELIVERY UNDER
19 U.S.C. 1448(B);
II) ENTERED OR RELEASED FROM CUSTOMS CUSTODY UNDER 19 U.S.C.
1484(A)(1)(A); OR
III) WITHDRAWN FROM WAREHOUSE FOR CONSUMPTION.
THIS DEFINITION IS APPLICABLE WHEN ASSESSING FEES FOR
PROCESSING MERCHANDISE. THEREFORE, THE REQUIREMENTS OF
ANNOTATING THE CF 3461-ALT OR SUBMITTING BLANKET REQUESTS TO
ESTABLISH DATE OF ENTRY IS HEREBY RESCINDED.
ALL RELEASES PRIOR TO OCTOBER 1, 1992, WILL QUALIFY FOR THE
LOWER MPF RATE.
