REQUEST REFUNDS THAT MAY BE AUTHORIZED BY LAW IF THE
GENERALIZED SYSTEM OF PREFERENCES IS RENEWED
RETROACTIVELY
PASS TO: IMPORT SPECIALISTS, INSPECTORS, ENTRY OFFICERS AND OTHER
INTERESTED PARTIES SUCH AS IMPORTERS AND BROKERS
BACKGROUND:
IN EMAIL MESSAGE 3168071, DATED JUNE 17, 1993, CUSTOMS
HEADQUARTERS ISSUED INSTRUCTIONS TO FILERS ON HOW TO REQUEST
REFUNDS THAT MAY BE AUTHORIZED IF THE GENERALIZED SYSTEM OF
PREFERENCES (GSP) IS RENEWED RETROACTIVELY. WE INDICATED THAT THE
SPECIAL PROGRAM INDICATOR (SPI) "A" MAY BE USED AS A PREFIXTO THE
TARIFF NUMBER TO REQUEST ANY REFUND THAT MAY BE AUTHORIZED BY LAW.
HOWEVER,WE LIMITED USE OF THE SPI TO PERSONS FILING PAPER ENTRY
SUMMARIES.
BASED ON INPUT FROM FILERS AND FIELD LOCATIONS, WE HAVE
RECONSIDERED THE ADVISABILITY OF ALLOWING PERSONS FILING PAPERLESS
ENTRY SUMMARIES TO USE THE SPI "A." WE HAVE REVERSED OUR EARLIER
POSITION AND HAVE DECIDED TO ALLOW FILERS TO USE THE SPI, EVEN IF
THEY ARE FILING PAPERLESS ENTRY SUMMARIES, INCLUDING ELECRONIC
INVOICE SUMMARIES. WE REITERATE, HOWEVER, THAT CUSTOMS WILL NOT
AUTOMATICALLY PROCESS REFUNDS FOR PERSONS FILING PAPERLESS ENTRY
SUMMARIES--THESE PERSONS MUST FILE A REFUND REQUEST IF AND WHEN THE
GSP IS RENEWED RETROACTIVELY. SINCE THE PAPERLESS ENTRY SUMMARIES
WILL NOT BE FILED WITH THE BLUE COVER SHEET AND WILL NOT BE IN THE
SPECIAL GSP BATCHES, A REFUND WILL NOT BE ISSUED UNLESS THE
IMPORTER REQUESTS A REFUND IN WRITING. INSTRUCTIONS ON HOW TO
REQUEST A REFUND IN WRITING WILL BE ISSUED IF AND WHEN THE GSP IS
RENEWED RETROACTIVELY.
