PAGE 99-45 OF THE HARMONIZED TARIFF SCHEDULE OF THE UNITED STATES
LISTS 100 PERCENT DUTIES THAT APPLY TO VARIOUS PRODUCTS OF THE
EUROPEAN COMMUNITY. THE RETALIATORY DUTIES WERE ANNOUNCED IN
PRESIDENTIAL PROCLAMATION 5759 OF DECEMBER 24, 1987, AND WERE IN
RESPONSE TO THE EC'S IMPLEMENTATION OF THE COUNCIL DIRECTIVE
"PROHIBITING THE USE IN LIVESTOCK FARMING OF CERTAIN SUBSTANCES
HAVING A HORMONAL ACTION." THEY APPLY TO BONELESS BEEF; PREPARED
OR PRESERVED TOMATOES; SOLUBLE OR INSTANT COFFEE; OTHER FERMENTED
ALCOHOLIC BEVERAGES CONTAINING LESS THAN 7 PERCENT ALCOHOL BY
VOLUME; FRUIT JUICES; AND PET FOOD PROVIDED FOR IN THE TARIFF
PROVISIONS LISTED BELOW.
THESE RETALIATORY DUTIES APPLY TO THE EUROPEAN COMMUNITY AS A
FOREIGN INSTRUMENTALITY. SWEDEN, FINLAND AND AUSTRIA WILL ACCEDE
TO THE EUROPEAN COMMUNITY EFFECTIVE JANUARY 1, 1995.
ACCORDINGLY, THE RETALIATORY DUTIES LISTED ON PAGE 99-45 OF THE
TARIFF SCHEDULE BECOME APPLICABLE TO GOODS THAT ARE THE PRODUCTS
OF THESE COUNTRIES.
ACTION:
1. EFFECTIVE AS TO GOODS EXPORTED ON OR AFTER JANUARY 1, 1995,
THE PRODUCTS OF SWEDEN, FINLAND, AND AUSTRIA, PROVIDED FOR
IN THE FOLLOWING HTS NUMBERS, ARE SUBJECT TO DUTIES OF 100
PERCENT:

THE 100 PERCENT DUTIES ARE NOT APPLICABLE TO SHIPMENTS
EXPORTED BEFORE JANUARY 1, 1995, BECAUSE SWEDEN, FINLAND AND
AUSTRIA WERE NOT MEMBERS OF THE EUROPEAN COMMUNITY BEFORE
THAT DATE.
2. PURSUANT TO 19 C.F.R. 142.3(A)(5), DISTRICT DIRECTORS MAY
REQUEST DOCUMENTATION THEY DEEM NECESSARY TO VERIFY THE DATE
OF EXPORTATION. THE DATE OF EXPORTATION IS THE DATE THE
GOODS LAST LEFT THEIR COUNTRY OF ORIGIN.
