SUMMARY FOR AUTOMOBILE PARTS

SPECIALISTS, OAS, INSPECTORS, ENTRY PERSONNEL, OTHER
INTERESTED CUSTOMS EMPLOYEES, BROKERS AND IMPORTERS.

BACKGROUND

IMPORT SPECIALISTS AT VARIOUS PORTS HAVE DISCOVERED A WIDESPREAD
PRACTICE BY BROKERS AND IMPORTERS OF IMPROPERLY REPORTING
STATISTICAL UNITS OF QUANTITY IN THE IMPORTATION OF AUTOMOTIVE
PARTS.

CHAPTER 87 OF THE HARMONIZED TARIFF SCHEDULES (HTS) CHANGED
SIGNIFICANTLY IN JANUARY 1995. THE NET QUANTITY UNITS IN MANY
10-DIGIT HTS NUMBERS WERE CHANGED FROM "X" TO "KG". SINCE THE
CHANGE TOOK PLACE, MANY BROKERS AND IMPORTERS HAVE NOT BEEN
REPORTING ACCURATE NET WEIGHTS.

MANY BROKERS AND IMPORTERS HAVE BEEN PRORATING GROSS WEIGHTS ON
MULTI-LINE PARTS ENTRIES BY USING LINE VALUE AS A PERCENTAGE OF
THE ENTRY VALUE. CONTACT WITH SOME FILERS HAS RESULTED IN
BENEFICIAL CHANGES IN REPORTING; HOWEVER, MANY FILERS COMPLAIN OF
THE DIFFICULTY AND EXPENSE IN PRESENTING ACCURATE DATA.

ANALYSIS

THE CUSTOMS REGULATIONS DO NOT PERMIT THE WAIVER OR AMENDMENT OF
ACCURATE STATISTICAL REPORTING. FILERS HAVE THE RESPONSIBILITY
TO PRESENT ONLY ACCURATE INFORMATION.

ACTION

THE FOLLOWING PROCEDURES ARE IMPLEMENTED IMMEDIATELY:

1. THE NET WEIGHT OF AUTOMOTIVE PARTS WILL BE PRORATED BY
VALUE FOR EACH LINE ON THE ENTRY SUMMARY.

2. IF THE NET WEIGHT IS KNOWN, THE NET WEIGHT WILL BE USED
ON EACH LINE OF THE ENTRY SUMMARY. OTHERWISE, THE
ACTUAL WEIGHT WILL BE PRORATED BY VALUE OVER EACH LINE
OF THE ENTRY SUMMARY FOR A PERIOD NOT TO EXCEED NINETY
DAYS, (BEGINNING JUNE 1, 1995).

3. BEGINNING SEPTEMBER 1, 1995, THE ACTUAL NET WEIGHT WILL
BE REPORTED ON EACH LINE OF THE ENTRY SUMMARY OF
AUTOMOBILE PARTS. (PRORATION OF THE WEIGHT WILL NOT BE
ALLOWED).
