Title:Changes to the Generalized System of Preferences (GSP)

There are changes to the duty-free treatment of certain articles under the GSP program. (See Presidential Proclamation 8394, dated June 29, 2009, and published in the Federal Register on July 2, 2009 (Vol. 74, No. 126)). These changes are effective with respect to goods entered, or withdrawn from warehouse, on of after July 1, 2009.

The following products are now eligible for GSP preference from all GSP-eligible countries and not only from Lesser-Developed Beneficiary Developing Countries (LDBDCs):

0710.10.00 frozen uncooked potatoes

0710.30.00 frozen spinach

Therefore, frozen uncooked potatoes properly classified under 0710.10.00, HTS and frozen spinach, properly classified under 0710.30.00, HTS originating in any GSP-eligible country are eligible for GSP preference.

The following product/country combinations are no longer eligible for GSP preference, as the President has determined that they are sufficiently competitive in the U.S. market and no longer need GSP treatment:

1604.15.00 prepared or preserved mackerel Thailand

2804.29.00 rare gases, other than argon Ukraine

2819.10.00 Chromium Trioxide Turkey

2918.99.30 Aromatic drugs derived from carboxylic acids India

2933.59.59 Nonaromatic drugs of heterpcyclic compounds India

3824.90.40 Fatty substances of animal or vegetable origin Argentina

3907.60.00 Polyethylene terephthalate in primary forms Indonesia

3920.59.10 Nonadhesive plates, sheets, film, foil, and strip;
noncellular; not combined with other materials;
of acrylic polymers; flexible India

7113.11.50 Certain silver jewelry India

7907.00.20 Zinc tubes, pipes, or tube or pipe fittings India

8607.19.03 Rail car axles Ukraine

8708.50.79 Parts of non-driving axles for passenger vehicles India

Therefore, these goods when originating in the specified countries are not eligible for GSP preference if the goods are entered, or withdrawn from warehouse, on of after July 1, 2009.
