A third delay in modifications to the action taken by the United States Trade Representative (USTR) in connection with the World Trade Organization settlement proceedings in the European Community (EC)-Beef Hormone dispute.
On May 13, 2009, the United States and the European Commission announced the signing of a Memorandum of Understanding (MOU) in the Beef Hormones dispute. Under the first phase of the agreement, the EC is obligated to open a new beef tariff-rate quota (TRQ) in the amount of 20,000 metric tons at zero rate of duty. In return, the United States is obligated not to increase additional duties above those in effect as of March 23, 2009. The first phase of the agreement provides that the United States will not apply retaliatory duties greater than those currently in effect. In order to meet the United States obligations under the MOU, the USTR has once again decided to delay the effective date of the additional duties imposed under the January 15, 2009 modifications from August 15, 2009 to September 19, 2009.
The net effect of the delays on implementing the modifications is that the following HTS chapter 99, subchapter III, provisions remain in effect:
