Title:Generalized System of Preferences Terminated; Andean Trade Preferences Extended for Six Weeks

The Generalized System of Preference (GSP) will expire on December 31, 2010. This long-running trade preference program has lapsed and been renewed in the past and there is an expectation that Congress will consider reauthorization of the program in early 2011, likely to be retroactive to January 1, 2011.

The Andean Trade Promotion and Drug Eradication Act (ATPDEA) which shares the same expiration date as GSP has been extended through February 12, 2011 for Columbia and Ecuador. The benefits for Peru were not renewed and will expire on December 31, 2010.

Importers should pay the normal trade relations (column 1) duty rate but continue to flag GSP-eligible imports with the applicable special program indicator (SPI) until further notice. Use of the SPI will help facilitate duty refunds if the program is retroactively renewed. (see also Cargo Systems Messaging Services [CSMS] # 10 – 000292). CBP will issue additional instructions pending GSP renewal.
