Clarification Regarding the ACE PRODUCTION Deployment Thurs May 18, 2017

Entry Summary EDI Validations – Items: CES-6442, CES-6443 – Cotton Fee Exemption:

Before 5/18/2017 ACE Production deployment, the Entry Summary (AE) validations would not require the 056-Cotton fee on a ‘cotton article’ line that would normally require the fee (HTS Tax/Fee Flag = 1). This is because all of the 056-Cotton fee exemptions had not yet been implemented.

In the 5/18/2017 ACE production deployment, an HTS chapter 98 pairing exemption (the final exemption) was introduced for 056-Cotton fee reporting on an Entry Summary ‘cotton article’ line in an AE transaction. Also, because that HTS chapter 98 pairing exemption was the final, un-implemented exemption for 056-Cotton fee reporting, a setting that tolerated a missing 056-Cotton fee on an Entry Summary line was also turned OFF.

After the deployment, the 056-Cotton fee must now be included on the ‘cotton article’ line that requires the fee (HTS Tax/Fee Flag = 1) unless one of the following exemptions apply:
• Entry Type is 11, 12, or 23,
• The ‘cotton’ HTS is paired with HTS (8-digit level) 9801.00.10, 9802.00.40, 9802.00.50, 9802.00.80, 9802.00.90, 9819.11.03, 9819.11.06, 9820.11.06, 9820.11.09, 9820.11.12, 9820.11.15, 9820.11.18, or (4-digit level) 9813,
• An AE 40-Record Fee Exemption Code - either value ‘1’ (Cotton) or ‘2’ (Other) – is submitted,
• A 52-Record is submitted where License/Certificate/Permit Type Code is ‘22’ (Organic Product Exemption Certificate) with a valid certificate number has been reported in License Number/Certificate Number/Permit Number.

Similarly, the 056-Cotton fee will not be accepted on an Entry Summary line that is exempt for the Entry Type and HTS pairing reason.

Also, if the calculated fee amount is less than $0.01, the Line User Fee (62 record) is still required to be reported with a zero fee amount as detailed in the CATAIR.

Note that, unlike ACS, there is no $2.00 de minimus exemption; that exemption was eliminated recently by Agriculture Marketing Service (AMS).
