On February 6, 2009, the Customs and Border Protection Agency (CBP) published a new chapter, “Participating Government Agencies” in the Customs and Trade Automated Interface Requirements (CATAIR).

The new chapter contains a PG data set that is designed for two purposes: first, to begin the development of a universal Participating Government Agency (PGA) data set and second to allow the Customs and Border Protection Agency to meet the electronic data collection requirements as determined by the Lacey Act. As CBP modernizes its computer system, this data set will be used as the single record layout for all input from the trade for PGA data. This data set will eventually replace other the data sets such as the FD, DT and FC records.

CBP will automate the Lacey Act requirements in several implementations. There will be an initial implementation of the Lacey Act for data collection via the Automated Broker Interface (ABI).

CBP intends to automate and make the process available for data collection for the Lacey Act data elements on April 1, 2009 in the Automated Commercial System (ACS). The Automated Commercial Environment (ACE) will automate this process at a later date.

ABI filers will need to follow the schedule in the Federal Register/Vol.74, No 21/ Tuesday, February 3, 2009/Notices that describes the phase-in schedule of the declaration requirements for goods of, or containing, plants or plant products. The schedule identifies the dates and range of harmonized numbers that need to be reported.

The Lacey Act consists of approximately 19 data elements that need to be filed with the HI, HN (Cargo Release) and EI (Entry Summary). Cargo Release (Entry) and Entry Summary already capture some of the required information. The PG data set will capture the additional data elements such as intended use, description, name of constituent element, quantity of constituent element, unit of measure, percent of constituent element, PGA line value, scientific genus name, scientific species name, container number, and source type and source country code.
