Section 301 on Softwood Lumber from Certain Canadian Provinces Implemented April 15, 2009

The Office of the U.S. Trade Representative is imposing 10 percent ad valorem duties on imports from Canada of softwood lumber products originating in Ontario, Quebec, Manitoba, and Saskatchewan until $54.8 million in duties is collected. This action applies to softwood lumber products that are entered for consumption or withdrawn from warehouse on or after April 15, 2009. See Federal Register Notice dated April 10, 2009 (74 FR 16436).

To collect these duties, a new Harmonized Tariff Schedule of the United States (HTSUS) number, 9903.53.01, has been created. This HTSUS number must be listed in addition to the HTSUS number where the product is normally classified on the entry summary documentation. The program updates to the Automated Commercial System (ACS) to allow for the electronic transmission of 9903.53.01 have been completed.

Other entry requirements are also applicable to these and other imports of softwood lumber from Canada. Importers are advised to refer to 19 CFR 12.140 and to 19 CFR 12.142 (interim, 73 FR 49934) for information regarding applicability and entry requirements. The procedures set forth in CBP's test program for post entry amendments may not be used by participants in that test to submit amendments regarding entries affected by this action.
