This CSMS Message is to remind PMS Filers of the calculation for the PMS month to assure timely filing and payment of PMS summaries.
All shipments that are released between the first day of the month and the last day of the month are to be designated with the following month as the PMS month.
PLEASE NOTE: The PMS month designation is based on the RELEASE DATE of the shipment and NOT the entry summary filing date.
CBP has seen an increase in PMS late payment penalties. Research has noted two recurring conditions requiring edits within your ABI program to avoid future penalties:
Both conditions below involve end of month release dates falling on a Friday and the filer's entry data shows an “estimated arrival/release date” for the following month.
1) Some cases involve shipments released on the last day of the month (Friday –April 29th) being combined with shipments released on the first day of the following month (Sunday – May 1st) for assignment with the same 10th day summary date and PMS month covering the summary date. The 10th day Summary date for both shipments would be May 13th.
The April release should be designated for the MAY PMS month.
The May release should be designated for the JUNE PMS month.
Some ABI programs are using the summary date of May 13th to assign a JUNE PMS month causing the April release to be paid late.
2) There were cases involving the release date as the last day of the month (Friday – April) and the filer's entry would reflect an “estimated arrival/release date” for the following month (Monday-May). The Filer's system does not calculate the “RR” Cargo Release Processing Results Message covering a release date update action. The release date update changes the release date to reflect an earlier release date (Friday's date) other than the estimated arrival/release date (May's date) sent in the filer's entry data. The ABI program does not send an “HP” Statement Delete Transaction to change the PMS month in response to the “RR” Cargo Release Processing Results Message covering the earlier release date change. The PMS month was originally designated for JUNE using the following month (May's date) as the release date. Since the statement change is not sent, the JUNE PMS month will cause the April release to be paid late.
Filers should contact their software vendors to verify their ABI program has edits to identify the correct release dates and send statement changes to apply the appropriate PMS month designation.
